DOJ investigating alleged criminal actions by eBay

SAN FRANCISCO (AP) — Federal prosecutors are investigating whether employees of online marketplace operator eBay Inc. wrongfully used confidential information from Craigslist to build its own classifieds site.
The investigation was disclosed in a copy of a grand jury subpoena obtained by The Associated Press on Tuesday. The subpoena was issued Sept. 7 by the Department of Justice in U.S district court in San Jose.
The subpoena seeks information and documents about incidents in which eBay employees allegedly misappropriated confidential information from the online classifieds site. The subpoena, which was reported previously by Reuters, aims to gather information and supporting documents related to a number of incidents in which eBay employees "engaged in alleged criminal activities and misconduct focused around the misappropriation of proprietary/confidential information from Craigslist."

A civil lawsuit filed in Superior Court of California in Alameda County yesterday charges Overstock.com Inc.28Overstock.com Inc.Mass MerchantOnline Sales:$876,769,000 Growth:5.7% See More with making “untrue and misleading” claims about its prices. The suit, which was filed by seven Northern California district attorneys, alleges that Overstock’s comparison prices, which the web retailer uses as a basis for setting discounts, are consistently inaccurate.
The suit states that since January 1, 2006, “Overstock routinely and systematically made untrue and misleading comparative advertising claims about the prices of its products.” The complaint charges that prices presented under the labels “List Price” and “Compare At (Overstock) Price” were not prevailing market prices and that Overstock “used various misleading measures to inflate the comparative prices, and thus artificially increase the discounts it claimed to be offering customers.”

Texas sends $269 MLN bill to Amazon for uncollected taxes

Texas has sent Amazon.com Inc. a $269 million bill for uncollected sales taxes on purchases made by state residents from the Seattle-based Internet superstore over a four-year period.
Now that Texas has gotten tough with the No. 1 online retailer, other states could be tempted to pile on with their own assessments as local governments face huge shortfalls, analysts said. Recent estimates put Texas’ two-year budget shortfall at as much as $21 billion.
Amazon.com Inc., with sales last year of $25 billion, said Friday that it plans to "vigorously defend ourselves in this matter."
The uncollected sales taxes are from December 2005 to December 2009 and include interest and penalties.
R.J. DeSilva, spokesman for the Texas comptroller of public accounts, said the bill was sent to Amazon.com in August. It wasn’t publicly disclosed until Friday, when Amazon.com revealed it in a regulatory filing.
"The company has requested a re-determination, which means this is an ongoing audit and could be decided as part of the administrative hearings process," DeSilva said in a statement. "The company would send documents, and this process will continue."
