Sellers Receive Checks as Part of $30 MLN eBay Settlement

Sellers on eBay Motors began receiving checks this month that were their portion of a $30 million settlement in a class action lawsuit. Two sellers had filed a class action lawsuit against eBay in 2009 alleging that eBay charged excessive fees for listing items in the "Parts and Accessories" category. eBay settled for $30 million in November, but denied it had overcharged sellers.
The court approved the settlement in December, and sellers began receiving checks this month.
The class consists of eBay sellers who paid Final Value Fees for selling items in the vehicle-related Parts and Accessories categories on eBay Motors between April 21, 2005, and August 26, 2009. eBay Store listings were not included in the settlement.

A battle over shipping rates

A lawsuit alleges that UPS and FedEx violate antitrust law by conspiring to lock in shipping rates. AFMS Logistics, the company that plans to re-file its federal complaint as early as tomorrow, seeks up to $60 million in damages.
AFMS Logistics Management Group, a shipping consultant to retailers and other shippers, has filed a complaint in federal court charging United Parcel Service of America Inc. and FedEx Corp. of antitrust violations by refusing to work with AFMS and similar firms to revise rate contracts on behalf of shipping clients.
AFMS, based in Portland, OR, charges that UPS and FedEx have “induced and persuaded” shippers not to deal with it, and that UPS and FedEx have threatened to raise the rates of any shipping clients who share their shipping data with outside consultants for the purpose of seeking re-negotiated rates from the two carriers.
